BOARD OF DIRECTORS MEETING MINUTES
AUGUST 2, 2002

Tom Chmiola called the meeting to order at 5:59 pm in unit #622.

Attendees:
Gene Miesse, Tom Chmiola, Margie Rus (Mann Properties), Bob Siskind, Frank Dean, Anne Giannelli, Vic Saville and Louie Napoli.

Board members absent:
None

Association Members Present:
Ms. Coschignano (Unit #672) representing Ms. Martin (Unit #718) and Ms LaRue (Unit #670) representing several unit owners that are trying to resolve how to eliminate the late night partying, loud noise, foul language and the resulting debris that remains .

Discussion regarding disorderly tenants:
Ms. Coschignano and Ms. Martin requested to attend the board meeting and present their opposition to complaints from other unit owners. Ms Coschignano advised the board that Ms Martin was unable to attend and that she was representing her. Ms Coschignano was given ample time to plead her case that there was no problem and that the complaints were unfounded in her opinion. When pictures of trash, beer cans, cigarette butts, old tires, etc, etc, were presented Ms. Coschignano claimed she had never seen anything. (She did say, however, that she was picking up cigarette buts and beer cans in the morning now) Ms. LaRue said that several unit owners are concerned about the late night noise, foul language (she stressed that it wasn’t damn or hell but very vulgar language) and the resulting debris left on the decks. Again, Ms. Coschignanao indicated that she had not witnessed any such behavior. She did say, however, that she was picking up cigarette buts and beer cans in the morning now.

After Ms. Coschignano and Ms. LaRue were excused the board discussed the issue in some detail and resolved that the only way to enforce our rules was to document, with a witness if possible, all abuses of the Casa Del Sol Association rules and City of Ocean City regulations. Mann Properties is to be copied on ALL complaints and fines for abuses of Casa Del Sol Association rules are to be levied as provided in the association By-Laws.

The Board requested that Margie Rus (Mann Properties) prepare a letter to MS. Martin. The letter should advise her of the results of the meeting: (#718 was to get a letter stating the next rules violation will result in a $250 fine. #672 was to receive a letter stating the premises needs to be cleaned up, debris and foul language, or a $250 fine will be levied.

Reading and approval of the 6/15/02 CDS Board meeting minutes:
Motion:
A motion to waive reading and approve the minutes from the 6/15/02 board meeting was made by Gene Miesse and seconded.
The motion passed unanimously.

Review of Financial Results:
1. Margie Rus (Mann Properties) covered the financial results as of 7/31/02.
Motion:
A motion to accept the financials as presented was made by Frank Dean and seconded.
The motion passed unanimously.

Canal Side Renovation Project:
1. Gene Miesse reported that Walt Smelter had told him that he could start the first 6 units as early as mid September if that was OK with the board. After considerable discussion it was decided that disruption to rentals and September inhabitants and the fact that we will not be funded until sometime in December we should keep to Walt’s original plan to start the first week in January, 2003.

2. Margie Rus (Mann Properties) proposed that Walt Smelter prepare the bid specifications for the project. She had talked to Walt and he said he could do it for about $2,000.00. We had discussed this at the June 15th, 2002 meeting and rejected it because there was concern that Walt could skew the specs. Margie then said she would try and get an engineering firm from near Salsbury, MD.

Old Business:
1. Exterior compliance issues:
a) Unit #648 White slider w/grids – Buck reported that legal council was in process of filing the suit approved by the CDS board at the 10/20/01 meeting.
Update 8/2/02 – Margie has sent another letter and again has received no response and wanted to know if she should proceed with fines. The board members were dismayed that the legal action approved last September and reported as in-process last November wasn’t in-fact started. Margie will follow-up.
b) Unit #664 White slider – A notification letter has been sent to the owner explaining the non-compliance. The letter also advises the owner that action will be taken by the board to correct the non-compliance at the expense of the owner if it is not resolved within 45 days.
Update 6/15/02 – Mann Properties has contracted with Bill Cole to paint the door...
Update 8/2/02 – Not reported. Do not know if painting has been completed or not.
c) Unit #666 White entrance door – A notification letter will be sent to the owner explaining the non-compliance. The letter will also advise the owner that action will be taken by the board to correct the non-compliance at the expense of the owner if it is not resolved within 45 days.
Update 8/2/02 - The owner contacted Mann Properties on 7/30/02 and requested that they hire a contractor to paint the door and bill them.
d) Unit #700 White entrance door – A notification letter was sent to the owner 7/25/02 explaining the non-compliance and advising the actions that will be taken if the it’s not resolved in 45 days.
Update 8/2/02 – do to an owner medical condition an extension has been approved. The owner has committed to having the door painted as soon as cooler weather arrives (by 09-30-02 or before the unit has sold).
e) Unit # 718 – staining of new street side Kitchen deck:
Tom Chmiola and Bob Siskind volunteered to stain this deck.
Update 6/15/02 – Tom and Bob have rescinded their offer. Margie Rus (Mann Properties) was requested to take action to get the deck stained.
Update 8/2/02 – Not reported. Status unknown. (a letter was to be sent by Mann Properties giving the unit owner 45 days to comply or Casa Del Sol will have the deck stained. The homeowner is responsible for the cost. The material to be used is TWP101, cedartone natural. This is the preservative currently in use. The deck has been unstained for approximately one year)


2. 600 Building:
a) Trash removal from underneath the building.
Buck advised that the cleanout and the access door repairs were completed and all that remained was to install rat wire around the plumbing chase in four of the units.

b) Shingle damage to north side mansard, west end of building.
Buck advised that this was warranty work and would be completed by Walt while his crew was working on the 770 Building.

3. 700 Building:
a) Repair of the bayside, 2nd floor, west end fire escape was completed by installing a brace on the fire escape stairwell wall. Buck Mann advised that this repair seems to be holding the wall tight. Buck was advised to use the same “brace” repair on other fire escape stairwells.
Update 4/21/02 – Additional braces have been ordered and will be installed prior to Memorial Day.

b) Trash removal from underneath the building.

4. Roof Replacement/Repair:
Roof replacements for 2002 are underway. Buck advised that the roofs for units 636, 638 & 640 were completed in March.

5. Individual Unit Maintenance:
a) Unit #700 Piling set back problem:
Motion:
A motion to have Mann Properties send Dave Ott (Unit #700) a letter advising that the pilings must be moved was made by Frank Dean and seconded.
The motion passed unanimously.
Update 8/2/02 – Mann properties informed the owners that the pilings must be moved in a letter dated 7/15/02.

b) Unit #640 request for interior repairs:
Motion:
A motion to have Mann Properties write a letter to the owner(s) advising that ALL interior repairs are the responsibility of the unit owner(s) with references to the Casa Del Sol By-Laws was made by Frank Dean and seconded.
The motion passed unanimously.

c) Unit #650 A/C problem:
Owner claims roofers damaged unit.
Mann properties had 2 estimates for repair done and both companies said total replacement was the only alternative due to the age of the unit.

d) Unit #676 Dock Repairs:
In a letter dated 8/1/02 the owner advised Mann Properties that their dock and pilings were loose.
Update 8/2/02 – On 8/1/02 Mann properties requested Kevin McGinty to evaluate the extent of the repairs. If the required repairs are minor McGinty is to go ahead and perform the work. If they are major they are to advise Mann Properties.

Next Board Meeting:
The next board meeting will be held Saturday September 21st, 2002 at 6:00pm in Unit 718 (Tom Chmiola). (This meeting date is being rescheduled)
